Senate can't gag President, says Escudero
MANILA, Philippines - The Senate cannot order President Aquino not to comment on the ongoing impeachment trial of Chief Justice Renato Corona, Sen. Francis Escudero said Monday.
Escudero said the President is not covered by the rules of the Senate. He, however, urged both the President and the Chief Justice to stop the word war especially after Corona urged Aquino to reveal his alleged psychiatric reports.
"May impeachment naman. Pwede ba hayaan na lamang ang korte na gawin ang kanyang trabaho dahil isang magandang bagay na ibibigay ng impeachment sa atin ay iwasan yang ganyang bangayan," he said in a radio dzMM interview.
The senator-judge said that under the rules, the lawyers and respondents in the impeachment case cannot discuss the merits of the case publicly.
"Hindi po covered ang Pangulo kaya mayroon siyang karapatan na sabihin ang kanyang saloobin," he said.
Escudero said one unseemly effect of the ongoing word war between Aquino and Corona is the constant mudslinging before the media by the 2 camps.
Last Friday, Corona challenged Aquino to reveal his statements of assets, liabilities and net worth (SALNs), bank records and even his psychological records. "Mayroon po tayong obligasyon na ipakita sa taong-bayan na maayos ang ating pagiisip," he said in a statement.
Corona's challenge came after the President accused the chief magistrate of lying in his 2010 SALN when he declared only P3.5 million in cash when he had P31.5 million in the bank.
Aquino later said he will not stop commenting about the trial, saying it is his duty to talk about the public’s sentiments.
“A democracy is the majority deciding for everybody and you cannot decide properly if there is no discourse within the contending sides in any issue. So to keep quiet about the whole thing is, I think, wrong. Time to time, I reserve my right to be able to say what I believe should be said to the people,” he said.
Smear campaign
A Philippine Center for Investigative Journalism (PCIJ) report earlier said Aquino declared a net worth of P54,999,370 as of December 31, 2010, representing a 256% increase in his wealth in 12 months.
The report said Aquino received P17,031,484 in "receivables" after the Aquinos sold a prime property in Antipolo that was part of estate of the Sumulong clan, the maternal relatives of Cory Aquino. He also received 2 real estate properties following the death of his mother, former president Cory Aquino, on August 1, 2009.
Corona's challenge for the President to reveal his psychological records harkens back to a 2010 smear campaign against Aquino.
During the 2010 presidential campaign, ABS-CBN received copies from 2 Nacionalista Party members of a fake psychiatric report that said Aquino suffered clinical depression.
The psychiatric report was declared fake by both Fr. Carmelo "Tito" Caluag and the Ateneo de Manila University psychology department.
The Nacionalista Party later denied issuing the fake psychiatric report.

The bank secrecy law is clear on stating that foreign currency accounts (dollar accounts) could not be disclosed to anyone unless with the written consent of the depositor. but since corona earned the ire of the president, pnoy ordered the two branches of the government to dig up corona's bank accounts in order to black mail the latter. that is one credible thing that would justify or explain why the bank accounts of corona were exposed and fell into the hands of the prosecution.
the malacanan tenant is the one who ordered BSP and AMLC to investigate corona. to do that, BSP came up with a dept. circular that classified certain people as "PEP" or politically exposed personalities. this is all intended to give way to the witch hunt which the palace tenant orchestrated and to circumvent the law so he could get back at his perceived political foes. with the advent of such dept. circular, BSP and AMLC began a special witch hunt for PEPs who can be a subject for audits and whose accounts can be examined. this did not just put the banking industry in bad light but it has a big impact to the bank depositors. it sends a disturbing thought that this government could illegally order an investigation of the bank account(s) of anyone using BSP and AMLC's. the memo itself deeply encroach into the rights of our people. we can safely say that the law could not protect anyone who's a perceived political foe of the chief executive. the tendency of pnoy being a dictator is right in front of our doorsteps.
for the record, the two branches of the executive (BSP and AMLC) have no business investigating the accounts (dollar) of corona for two reasons. first, there is no court order to investigate the bank accounts of the chief justice. second, the law is clear in bank secrecy that all foreign currency deposits should be treated with utmost confidentiality unless with the written consent of depositor.
What the BSP and AMLC could not deny is that, they have examined the bank records of corona in PS Bank without a court order nor did they determine probable cause to start an investigation. one undeniable fact is that, the BSP auditors accompanied by certain Jerry Leal (anti-frau expert) have investigated the 1 million peso that corona won in a bank raffle. however, the million dollar question is this, why would BSP and AMLC would do a joint investigation involving the chief justice if there is no direct order from the tenant of malacanan? remember that this investigation on corona's accounts happened late last year while the president is berating the chief justice in many forums.
the tenant of the palace is hardly known to uphold, obey and defend the law. to make things worse, BSP and AMLC both vowed to execute the illegal orders of the boy from the stinky pasig river. take it from garcia, the man has more credibility than the man (?) in the palace.

It is his right to say what he wants to say against Corona as Corona does say against PNoy. For as long as both parties do not go beyond the moral ethics of their position by being too personal with their criticism. This is a democratic country. It appears that Corona is losing the war of words with the president because all the evidence against him showed without reasonable doubt that he is guilty of crime against the Filipino people. If he is really clean as he claims, he will allow his records to be open to the public and not hide from his previlege as a SC justice member.
Corona used his brilliant mind to manipulate justice to favor powerful politicians, wealthy businessmen and corrupt government officials based on the facts and past actions he did while he was a government employee. He had lost his integrity, credibility and trust of the Filipinos when he became a lap dog of the Arroyo's and lied on his declaration of his true wealth. For a few pieces of silver and gold he sold justice and fairness to favor those who can afford it. People on the back ground are able to see this because information travel so fast in this day and age. Any misdeeds Corona conducts, because of his position in the SC, can leak out fast before he can cover it. The Filipino people, who easily forgives, gave him a golden chance to redeem himself but he blew it by being adamant not to show all his records.
Also, he and his defense team tried to cover his misdeeds by informing the Filipino people with questionable alibis and below the belt accusation that majority of the senators receive 100 million peso bribe from the current administration without a concrete proof. Now what will the majority of the sensible Filipinos will deem about his case. CORONA IS A LIAR, NO CREDIBILITY, DO NOT HAVE THE RIGHT TO RECEIVE THE FILIPINO PEOPLE'S TRUST AND SHOULD BE CRIMINALLY CHARGED FOR HIS CRIMES AGAINST THE FILIPINO PEOPLE!

yes, please, corona needs a psychological test too. for a mature man and a judge at that, corona easily cries in public like he misses his pacifier. it appears that corona has some unresolved psychological issues. the earlier those issues are addressed and dealth with, the better for corona. it's embarrassing to see him cry often in public.
