Umali: 'Small lady' came from PSBank?

MANILA, Philippines - Oriental Mindoro 2nd District Rep. Reynaldo Umali on Tuesday said a bank employee could have leaked documents on Chief Justice Renato Corona's bank accounts in Philippine Savings Bank.

"It could have come from the bank. I think it is one of the bank personnel who is really getting  fed up with all of these lies and, para sa bayan, naisip siguro niya it's about time these things come out in the open," Umali told ABS-CBN News Channel's "Headstart."

In the interview, Umali denied that House prosecutors could have manufactured the document on their own.

"If you look at the document with all the handwritings and signatures and even the signature of Chief Justice Corona contained therein coupled with the facsimile of passport and some other documents, it would be foolhardy on our part to even think of manufacturing it. I cannot understand where that idea came from," he said.

He added that any alterations of the document could have come from the bank.

"This is a living document as far as the bank is concerned...The bank president has full control of this document. If there is anyone that can alter this, it is them not us."

Umali has come under heavy criticism for saying that a supposedly leaked PSBank document was given to him by a "small lady" inside the Senate. House prosecutors used the document to request for a subpoena to Corona's bank records.

CCTV footage in the Senate found no trace of the "small lady" who supposedly approached Umali.

In his interview, the congressman stood by his story that a small lady gave him the documents. He denied that he knew the source of the documents.

"I confess to Almighty that I do not know the person. It is really a lady, it is a very insignificant person to me. I did not even have a glimpse of her. It happened so fast," he said.

42 points of difference

Umali also questioned the testimony of PSBank president Pascual M. Garcia who said there were "42 points of difference" in the allegedly leaked document and the originals in the bank.

In his testimony, Garcia noted the 3 specimen signatures in the bank's original document "are written with a fluid stroke indicating a spontaneous and natural execution and they are likewise thicker indicating use of a sign pen."

On the other hand, he said the signatures on the annexed document submitted to the court showed "visible tremors indicating inconsistent pressure and possible tracing and the lines are thinner indicating the use of a ballpoint pen."

He said the annexed document also had a notation "PEP" or "politically exposed person", which does not appear in the original.

Umali, however, said Garcia cannot be relied on as an expert witness.

"For one, he is not an expert witness. He is not a document expert or a handwriting expert. I think he is going beyond his scope in trying to point out these differences," he said.

Asked about the differences between the documents, he said details on the bank documents such as highlights, underlined items and an annotation of "PEP" or politically exposed person could have been added later.

"In the photocopying of this document, things could change from the original to the photocopied document to another document photocopied for the nth time," he said.

Amlac denies audit

During Monday's hearing, Garcia also revealed that representatives of the Anti-Money Laundering Council and Bangko Sentral ng Pilipinas (BSP) examined Corona's documents during a bank-wide audit in September to November 2010.

He said he was not certain if the Amlac photocopied the documents.

The BSP, meanwhile, denied leaking Corona's bank records, saying that the audit was part of a regular examination of the bank.

"[BSP examiners] never requested to see the deposit account records of the Chief Justice nor were they presented the deposit accounts of the Chief Justice," the central bank said.

"BSP examiners therefore could not have copied nor secured copies of such deposit account records including the signature cards of Chief Justice Renato Corona," it added.

Amlac also denied auditing Corona's records.

since majority of our legislators have no "credibility" and "honor" to proctect, then it is pointless to urge them to get out of the cocoon of executive subservience. after all, we knew that it is the chief executive who marshalled the impeachment of the chief justice. we knew that these political turncoats allied with pnoy have been bought by the latter using the swelling budget for PDAF. we knew that many of them (congressmen) have pending corruption charges in the office of the ombudsman. thus, justifying their blind following to the chief executive.

two of the most vital and important constitutional safeguards in relation to the house rules of impeachment were revised by the 15th congress to hasten the impeachment of a perceived arroyo ally, ombudsman merciditas guttierez. the same "revised" impeachment rule was used in corona's impeachment.

house rules on impeachment requires that the affiant, has "read" the pleading and allegations and that the allegations are true act of ones personal knowledge based on authentic records. "personal knowledge" and "authentic records" two of the most important consitutional safeguards that were revised from the house rules on impeachment. this is ofcourse intended to make it easy for pnoy and the subservient congress to file an impeachment complaint to anyone who earns the ire of the president.

the prostituted allies of noynoy railroaded the impeachment complaint without giving the impeachable officer an opportunity to answer the allegations. the law requires that before an impeachment is passed, it should issue a written notice to the "impeachable officer" so that the subject of the impeachment complaint could answer back the allegations against him. this is essential part of the impeachment process that was not followed. a very simple aspect of due process that was ignored by the 15th congress. however, the worse thing that pnoy and his prostituted allies have done is to pass a constitutionally flawed articles of impeachment that failed to meet the constitutional requirement of verification, making the articles of impeachment comparable to a toilet tissue paper.

but that was not the end of it. the senate assembled as an impeachment court that tries the impeachment of corona basing it to a badly written shitty pieace of paper. the impeachment court had rejected the request from the defense to conduct preliminary hearing. as a consequence, several times the proceeding was interrupted because the house prosecutors appeared to be unprepared for the trial. this gave credibility to claims that pnoy and his prostituted allies never expected that the badly written articles of impeachment will undergo a decent scrutiny before the senate. they've expected the chief justice to do a merci but they've miscalculated it.

prior to the impeachment trial, the prostituted allies of pnoy held a press conference waving a document allegedly pertaining to corona's list of properties. however, that chief justice answered back in his speech and bravely declared that the list is bloated. during the trial, the defense managed to proved that the list is indeed inaccurate. during the senate hearing, the prosecution failed to show certified true copies of titles and properties insofar as CJ's SALN is concerned. they also failed to show individuals that will testify on the signatures and certify relevant documents, yet the prosecution has the nerve to expose allege "evidence" with questionable validity to the public.

the prosecution alleges the non-disclosure of CJ's SALN. however, the eager judge drilon managed to extract the SALN of corona which the prosecutors failed to do. immediately after this incident, prosecutor bargaza announced before the court that the prosecution panel is abandoning that allegation against the chief justice (non-disclosure of SALN). the prosecution mistakenly claimed victory into something that evidently proves that innocence of the defendant.

the prosecution claimed that corona's assets have increased by 8 million from the period of 2009 - 2010. however, they failed to mention that corona gained 8 million from the proceeds of the sale during 2010. this will justify the increase of 8 million.

the blunders of the prosecutors are swiftly accumulating, they needed strategize before they mess up the entire case. they've readily moved to the accusation if ill-gotten wealth. however, since the articles of impeachment itself does not allege corona of amassing ill-gotten wealth, the impeachment court made a ruling not to touch the issue.

pnoy allies are done scrambling and scrounging for evidences. now they are currently involved with salacious gossip and faking documents all intended to portray a bad image of the chief justice. however, these apparatchiks have only shown classic stupor by coming up with fabricated and stupid story of a small lady to cover up this administrations despicable manipulation on the on going impeachment trial.

the cooked impeachment compliant from Macau is an evident proof that the usurpation of democracy is the rule. the president instigated a toxic political situation and is now causing many people. this is all intended to have full control of the judiciary without declaring martial law. his bid for ultimate power is disguised under the claim of transparency.

the greedy, the influential, the opulent and omnipotent corrupt rich are still ruling this country.
